All postings, messages, or text posted on, transmitted through, or linked from the site, are the sole responsibility of the person from whom such content originated. You are entirely responsible for all content that you post, email or otherwise make available through the site.

By uploading or otherwise posting any content on the site, you represent and warrant: (i) you own or otherwise have all necessary rights, including but not limited to copyrights, to the content you provide and the rights to use it as provided in this policy; (ii) all information you provide is true, accurate, current and complete, and does not violate these Terms of Service; and, (iii) the content will not cause injury to any person or entity.

For all such information and material, you grant theloftbillings.com, its affiliates and related entities a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, copy, modify, display, archive, store, distribute, reproduce and create derivative works from such information, in any form, media, software or technology of any kind now existing or developed in the future.

Submitting Comments

Theloftbillings.com encourages readers to engage in civil conversation with their neighbors. Comments that are submitted are not posted to the site immediately. They go into a queue to be moderated and may take several hours to be reviewed before being approved or deleted. We will never edit or alter your comments, but we do reserve the right to remove comments that violate our code of conduct.

By using the site, you may be exposed to content that you may find offensive, indecent, inaccurate, misleading, or otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of the Site and any of its content, including but not limited to whether you should rely on said content.

In the quick-paced atmosphere of online comments and message boards, the moderating staff will ocassionally miss an offensive comment and post the comment to the site. If you find a comment that you believe should be removed, please contact us using our offensive comment report form. The reports we receive are reviewed by the moderator and a decision is made, usually within a few hours, whether the comment should be removed or allowed to remain on the site. Submitting an offensive comment report DOES NOT guarantee that a comment will be removed. If you have specific questions you would like an answer to, please leave your email address along with the infomation about the comment. A moderator will try to contact you again once a decision has been reached. Also, please provide an accurate description of the comment so it can easily be located.

You also agree that under no circumstances will theloftbillings.com or its affiliates be liable in any way for any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed or otherwise made available via the site. You acknowledge that theloftbillings.com shall have the right (but not the obligation) in its sole discretion to refuse, delete or move any content that is available via the site, for violating the letter or spirit of the policy or for any other reason. theloftbillings.com reserves the right to delete any posting or message at any time if we find it violates our posting rules (below).

Please be careful and responsible whenever you are online. Should you choose to voluntarily disclose personally identifiable information in public areas on our site, such as in message boards or article comments, that information can be viewed publicly and can be collected and used by third parties without our knowledge and may result in unsolicited messages from other individuals or third parties. Such activities are beyond the control of theloftbillings.com and this policy.

Comments that are not in written in English may not be approved. Unfortunately, we do not have the resources to translate comments from other languages to make sure they comply with our comment policy.

Links to other websites CAN be posted within the comments, but they CANNOT include the phrase "http://". If you would like to post a webpage address, leave "http://" off the beginning of the URL.

Online behavior, posting rules

You agree not to post, email, or otherwise make available content:

    * that is unlawful, threatening, defamatory, pornographic, libelous, intended to be personally insulting or invasive of another's privacy, or harms minors in any way (calling someone a moron, idiot, etc falls under this category);
    * that implies a person, including a suspect in crime-related story, is guilty of a specific crime until they have been proven guilty in a court of law;
    * that encourages or suggests an act of violence in such a way that the action is likely to occur;
    * that harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
    * that purports to be from any person or entity, including but not limited to a Gazette employee, or falsely states or otherwise misrepresents your affiliation with a person or entity;
    * that includes personal or identifying information about another person without that person's explicit consent.
    * that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, or content that you do not have a right to make available under any law or under contractual or fiduciary relationships.
    * that constitutes or contains "affiliate marketing," "link referral code," "junk mail," "spam," "chain letters," "pyramid schemes," or unsolicited commercial advertisement.
    * that advertises any illegal services or the sale of any items the sale of which is prohibited or restricted by applicable law, including without limitation items the sale of which is prohibited or regulated by Montana law;
    * that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
    * that disrupts the normal flow of dialogue with an excessive number of messages (flooding attack) to the service, or that otherwise negatively affects other users' ability to use the service;

Additionally, you agree not to:

    * contact anyone who has asked not to be contacted;
    * attempt to gain unauthorized access to The Loft's computer systems, web hosting services, or any other user's computer systems, or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Service or the theloftbillings.com website.

Public figures

Theloftbillings.com makes exceptions for some of the rules above in cases where the subject of a comment is a public figure. Public figures are generally those that live and/or work in the public eye on a consistent basis. This list may include, but is not limited to prominent politicians, high-level public servants, and high-profile community members. Theloftbillings.com reserves the right to determine who can be considered a public figure.

We feel public figures - such as a mayor, senator, or U.S. president - should be held to a different standard and therefore comments that would otherwise be considered personal attacks or other defamatory language are allowed provided they do not accuse someone of a specific crime, attack parties unrelated to the issues (family, friends, co-workers), use explicit language, or attribute inaccurate quotes.

Theloftbillings.com privacy policy

Theloftbillings.com is committed to protecting consumer privacy online. We believe that greater protection of personal privacy on the Web will not only protect consumers, but also increase consumer confidence and ultimately their participation in online activities. The purpose of our policy is to inform you about the types of information we gather about you when you submit a comment using the Talk Back feature.

How we gather information

When submitting a comment, we record the "nickname" choosen by the author, the content of the post, the time the comment is submitted, and the IP address of the computer used to author the comment. An IP address (Internet Protocol address) is a unique number that devices use in order to identify and communicate with each other on a network (such as the internet). We use the IP address as a search tool to identify comments written by the same user. IP addresses are not publicly available.

Archiving and removing comments

The approved comments on theloftbillings.com articles are available indefinitely. Comments that are not approved are purged from the system.
